The burden of proof will be on the prosecution. Doesn't help when the media says, "Oh there wasn't a gun," then it turns into, "Yes, there was a gun."

This will get some play because of the status of the victim in this case.

Yes it is. It's also hard to claim you are the defensive party when you chase down and ram the vehicle of the other person.

Agreed. The claim that Hayes accidentally hit Smith because Hayes needed to take down his license plate is bullshit. Hayes had a passenger who could have taken a photo. Or one of them could have average vision to read the license plate from a safe distance. I mean, Smith was stopped at a red light, wasn't he? Why would you be going so fast as to hit Smith and cause his car to hit another car? That's a hard story to buy.

Louisiana is definitely a stand your ground state.

I know of one that happened about 15 years ago or so here in my area i can give as an example:

A guy i sorta know was involved in a drug deal gone bad.
He and the guy with him unloaded their pistol, then took the dead guy's gun and unloaded it on him as well.

18 total shots landed.
they dumped the body in a local canal, drove the car out to where the road ends and marsh begins and set it on fire.


they each served less than 6 six years on drug charges and obstruction of justice.
both were let off on the homicide for "self defense"


11 shots from one gun.
7 from another into a body that was most likely already dead.

self. defense.

Doesn't help the defense trying to use Stand Your Ground when Hayes approached Smith's vehicle and shot him there, or that Smith was shot 8 times, including 7 times in the back. That's pretty much the antithesis of standing your ground--it's looking for and creating violence.

Will Smith was on track to graduate from the University of Miami's inaugural MBA program for artists and athletes when the former New Orleans Saints defensive end was shot and killed last month.

On Thursday night, Smith's wife, Racquel, accepted that masters degree on her late husband's behalf during the school's graduation ceremony.
