The contact was intentional but the hit area wasn't. As a DB it sucks but I don't believe it to be malicious outside of the norms of just trying to play physical and shit getting sideways (literally) on you.

I agree it wasn't malicious... but he went in with bad technique. And that's a lot of what this rule is about -- reducing long-term brain damage to all parties from bad aggressive tackling techniques.
