I plead the 5th....that is unless BKB has decided that it is an unnecessary amendment just like the 10th is and therefore we shouldn't worry about it.
[By the way, although I never posted my response to him (I will eventually), essentially his interpretation of the 9th means the first 8 aren't necessary.]
