With the new M coming out, and the 335 having nearly identical performance #'s the market for the E46 is quite soft right now. I bought mine back in the early spring and got a great deal on it. You can get a used one and tear out all of that stuff and not feel so bad about it. I have taken mine to the track twice and it is a frigging blast. The only mods I have made on mine are upgraded the brake pads, stainless lines, and upgraded the fluid. I have a spare set of rims that I can change either track or winter tires onto when the time comes. My only issue with the car is my boss. He does not like me driving it for work.
PS. I still have an 02 Maxima SE for sale if that so happens to be anyones dream car.

I agree. To me, the BMW M series represent a compromise, not that there is anything wrong with that, it just all depends upon what you want. If you want a sportcar-esq sedan that you can drive everyday, take your gf and another couple out to dinner, and still be able to tool up and down the backroads late at night, the M5 may be just for you. For me though, it just does not offer the ultimate sports car experience, which my 911tt does provide. The flat six whine, the rear biased oversteer, the unyielding Porsche brakes, the (comparatively) spartan dashboard, the utterly useless back seats. It all provides an experience that cannot be matched by the BMW if you are basically looking for a race car that is neutered for the streets. Granted, this idea is taken to the nth degree with the GT3, but at the margins I am willing to sacrifice a little engine roar for air conditioning at this point of my life.
From my list above, anyone can tell I am a Teutonic car guy all the way, and with that I think that BMW offers some really great cars. I just dont think that they are targeting the same market at Porsche, which perhaps is just a little more sportscar purist in nature. Just my 2 cents.

I was lucky enough to take one of these on the track a couple weeks ago at a Drivers event. Not the most powerful car I have ever driven, but drives like a go cart. The most fun I have ever had in a car.

Yeah, the 335 is a fun car to drive. I personally think that BMW did a great job on the new three series. I like them a lot actually. I would take them over any other car in their class.
