What an Education or Uniform Treatment

Are school uniforms a good or bad thing? If the school says you can opt out of wearing a uniform then do they in fact have a UNIFORM policy? If you opt out, do you not have to make that clear? (The school says she was unclear). So is this girl on firm ground taking the school to task? LINK
Either way this trial goes, this should be educational for her. Perhaps she should write up her experience as plaintiff in this civil case for her Civics classes.

A 13-year-old Los Angeles girl who refuses to wear a school uniform has taken her fight to court, charging that school officials violated her civil rights by demanding she wear the blue skirt and white blouse.
Duan'ne Land claims that she has been harassed, humiliated and even "battered" by staff at Horace Mann Middle School despite a Los Angeles Unified School District policy that allows students to opt out of wearing a uniform.
"From time to time I was afraid of going to school because of what was going to happen next," Land told a Los Angeles Superior Court jury during her testimony on Tuesday. "But later on there was less messing with me."
Land said that when she gave an administrator a note from her grandfather asking to be excused from wearing a uniform the man "wadded it up and threw it on the ground." She said another staff member once grabbed her by the arm and yanked her into an office for wearing street clothes.
The teen's lawsuit seeks to bar the school from disciplining her over the uniform issue, along with unspecified monetary damages for violation of her civil rights, infliction of emotional distress and battery.
Lawyers for the district concede that students have the right to decline a uniform, but say Land never made it clear that she was doing so and was not mistreated. They say she was never kept out of school or sent home.
During opening statements in the trial on Tuesday, Land's lawyer said that after the girl stopped wearing her uniform, staff members threatened to suspend her, refused to allow her picture to be taken for the yearbook and barred her from a Valentine's Day dance.
According to the lawsuit, administrators also frequently detained her at the principal's office and twice stood her against a wall and scolded her.
"The wrongdoing alleged herein has interfered with plaintiff's education and denied her civil rights in violation of the State Education Code, state Constitution, and the Constitution of the United States," the lawsuit charges.
The trial, which continued on Wednesday with testimony expected from the school principal, was scheduled to last five days.
 
Considering most junion high school students are lemmings that simply follow whatever fashion trends they see on MTV, one could say there is a student uniform....just not one approved by the school authorities.

I've never understood, even when I was one, why teenages put so much imporantance on their clothes. Try finding a way of experessing yourself that is actually substancial rather than just being another clone.

1) It is not against her civil rights to make her wear a uniform any more than it is against mine to have to wear a suit every day. People who have time to focus on absolute garbage like this need more to do in their lives.

2) I am all for school uniforms. Numerous studies show that it increases performance in the schools just as a suit and tie increases productivity in the workplace. As much as I hate taxes (as many of you know), I would agree to a small increase to fund blazers, ties, and skirts for the public schools. I think it would be beneficial at all levels. Hard to make fun of someones clothes when you have the same thing on. Impossible to one up the next girl who has the latest prada. Unless gangs change their colors to blazer navy blue probably hard to look like you associate with a gang.....

While I philosophically agree with you on this stance, I'm not certain the law as interpreted by the courts agrees. You work for a private industry, she goes to a public school, so there are different standards. I think in these cases the burden is on the school to show the uniforms serve a useful function in promoting an educational environment. I think most schools who adopt uniform codes meet this challenge, but this school might be in trouble if her claimed treatment is found to be factual by the court.

Yeah - I knew someone was going to post this. You can draw analogies to public work as well. Judges must wear robes, cops must wear uniforms, etc, etc. My feeling is in the end, she is getting a damn education for free. If the they want her to wear a damn uniform, put it on.

Eh, adults really aren't much better. In fact they can be much, much worse and set a terrible example as they attempt to keep up with the latest and "coolest" electronics, cars, clothes, vacations, etc.

I read through and didn't see anything, but is this a private school, or public? If its private, then I can see the school's view on wanting her to wear the uniform (even though if what the girl claims is true, they went in the wrong way about it), but if it is a public school, then how the kids dress (within reason) should be fine.

I'm actually much more productive on casual fridays because I feel more comfortable.

The way I read the story, the school has a uniform. However, students can opt out of the uniform if they so choose.

The article didn't state the process for opting out (if there is one). If the girl followed the rules, she should not have to wear a uniform. If she didn't follow the rules (ie, didn't go through the process of opting out) then she should have to wear the uniform until she completes the "optout process."

I don't care one way or the other for uniforms. I've heard of similar studies that NYB stated, however I do disagree with the argument of they cannot "one-up" each other. The wealthier kids will have the better shoes (usually need to be black... brand name isn't stated), nice watches/jelery (or the "better" cross hanging from their neck), high end glasses for those with glasses, the nice wallet, "better" backpack, purse (if girls can wear them) etc., etc. (read, anything else they can purchase and carry "legally" that the less fortunite cannot)...
