Cop who fell on the job sues family of baby who almost drowned -- South Florida Sun-Sentinel.com

"CASSELBERRY - In January, 1-year-old Joey Cosmillo wandered into the backyard and fell into the family pool. When his mother hauled him out, he wasn't breathing. Rescuers were able to bring him back to life, but he suffered severe brain damage and cannot walk, talk or even swallow.

Now, his family faces another burden: One of the rescuers, Casselberry police Sgt. Andrea Eichhorn, is suing, alleging the family left a puddle of water on the floor that afternoon, causing her to slip and fall."

Not so amazing when you see how many people sue over the slightest excuse. Our society today gave birth to and fosters this way of thinking. It's all about one person against the corporations and or society or just plain people. there is no blame since it is always "someone else's Fault".

This lawyer has never heard of proximate cause.

I talked him out of suing the grandparents. If they hadn't given birth to the mom (or dad) then they wouldn't have owned a pool that needed to be baby proofed, there would have been no water, and dipstick wouldn't have slipped on it it.

Come to think of it, he was eyeballing the great-grandparents too, but he figured he was getting to close to Kevin Bacon being responsible, and he tells me he loved River Wild, so he didn't want to go that far.

Follow up story: the cop was placed on leave, then announced that she will drop the lawsuit. My guess is that she became quite the embarrassment to her department.

While she did break a kneecap and lost two months of work, ALL of her medical expenses were covered by insurance. There was no financial reason for doing it. It's just stupidity.
