Second charge of receiving stolen property dismissed

TUSCALOOSA, Ala. (AP) -- Alabama linebacker Juwan Simpson pleaded guilty Wednesday to a misdemeanor charge of handgun possession without a license, while a misdemeanor charge of receiving stolen property was dismissed for lack of evidence.

Simpson, 21, agreed to pay a $100 fine and $200 in court costs in connection with the handgun charge, The Tuscaloosa News reported Wednesday on its Web site.

"I'm happy all this is behind me now so I can pay attention to school and to football," Simpson said outside the courtroom.

Simpson was arrested May 20 by a sheriff's officer after being stopped for erratic driving on Interstatperty and carrying a pistol without a permit.
He earlier agreed to enter a court-based drug treatment program to resolve the marijuana charge.

Prosecutor Bill Veitch, Bessemer's chief assistant district attorney, said he recommended the stolen property charge be dropped after verifying Simpson's claim he took the handgun to a Northport police officer, and the officer told him it wasn't stolen.

The gun was registered as stolen in Decatur. Veitch said the officer probably entered the wrong serial number into the database.

UT signee named in Powell sex probe

A female assistant principal at Powell High School has been suspended temporarily while Knox County school officials investigate allegations she had a sexual relationship with a student athlete and tampered with students' grades last school year.

Assistant Principal Kim Kallenberg, 36, has been on administrative leave with pay since July 14 pending the outcome of the investigation by the district's human resources department, schools spokesman Russ Oaks said Tuesday.

One student at the center of the allegations appears to be Joseph Lee Smith, a 2006 Powell graduate and multi-sports standout who received a full athletic scholarship to play football at the University of Tennessee this year.

The News Sentinel has obtained a copy of an affidavit signed by Smith that says he "never had any sexual and/or inappropriate relationship with Kimberly L. Kallenberg." The affidavit says Smith is over 18 years old.

Smith played football and basketball at Powell after transferring from Central High School in Knox County before his junior season. He enrolled at UT in June for the first session of summer school.

A 6-foot-6, 245-pound tight end/defensive end, the high school star committed to play football at UT in February 2005, choosing the Vols over Virginia Tech and Alabama.

"This is the first we've heard of the situation," said Tiffany Carpenter, a UT Athletics Department spokeswoman. "At this time, we do not have plans to investigate. However, we will continue to monitor the situation."

Smith's father, Daryle R. Smith, is assistant football coach at Powell High School. He also played football at UT, from 1984-86, before beginning a six-year career playing professionally in the National Football League.

"It knocked my socks off," Daryle Smith said. "I’m very surprised, I don’t know who has an ax to grind. This is one of those things that is fantasy."

He said it was a shame that the allegations could jeopardize the principal and his son's career.

Kallenberg has been an assistant principal at Powell since 2003, and she worked as an assistant principal at Karns High School for one year before that. She began working in Knox County in 1997 as an English teacher at Powell High School.

Knoxville attorney Gregory P. Isaacs said Tuesday his firm is representing Kallenberg.

"Our firm's been retained to represent Assistant Principal Kallenberg regarding these ridiculous allegations," Isaacs said. "Assistant Principal Kallenberg vehemently denies any inappropriate relationship with a student at Powell High School or any improprieties relating to grades.

"In fact," Isaacs continued, "Mrs. Kallenberg has met with school authorities and has cooperated fully with their investigation."

Oaks said Tuesday that supervisors in the district's human-resources department have informally been looking into the allegations for about a month.

"We are investigating allegations of grade changing or inappropriate access to grades as well as an administrator having an inappropriate relationship with a student at Powell High School, and that (administrator is) Kim Kallenberg, an assistant principal," he said.

Whatever the outcome of the investigation, Kallenberg will not return to Powell High School, Oaks said.

"The superintendent has determined that given the nature of the allegations and the nature of the atmosphere in the building, that it would be in the interest of everyone for Kim Kallenberg not to return to the building," Oaks said.

Oaks said the district has forwarded the sexual allegations to the Department of Children's Services.

Oaks said he could not confirm the name of any students connected to the investigation because of the federal student-privacy law. He also could not say whether the student alleged to have a sexual relationship with Kallenberg had his grades tampered.

"The grade allegations involve a number of people," he said.

Oaks explained that the district also is looking into whether "students (were) getting inappropriate course credit — taking one history course and getting credit for another, for example."

Knox County Schools Superintendent Charles Lindsey also placed Powell High Principal Diane Psihogios, 53, on administrative leave with pay on July 14. Lindsey has since named Ken Dunlap, the principal at Northwest Middle School, to replace Psihogios.

Oaks said Lindsey plans to reassign Psihogios, who has been the principal at Powell since 2004 and who won the 2005 state principal of the year award from the National Association of Secondary School Principals and MetLife.

"Diane's move was related solely to the academic and administrative atmosphere of the building," Oaks said.

Kallenberg and Psihogios could not be reached for comment Tuesday.

Ex-Central Michigan player who started jail term early given boot

MOUNT PLEASANT, Mich. -- Central Michigan athletic officials have told a jailed former football player who wants to return to the team that he should pursue his playing career elsewhere.

Jerry Seymour, 21, of Miramar, Fla., pleaded no contest July 18 to attempted assault with a dangerous weapon in the 2004 fatal beating of DeMarcus Graham, 26, of Flint, outside a bar.

On July 20, Seymour voluntarily canceled his bond so he could begin serving jail time with hopes of being able to return to school and resume playing football as soon as possible.

The charge carries a penalty of up to two years in jail, but officials have said Seymour is likely to get a sentence ranging from probation to six months behind bars when he returns to court Aug. 21. Seymour would get credit for the month he spends in jail before sentencing if he is sentenced to time.

Central Michigan athletic director Dave Heeke said Thursday that members of the sports program, including football coach Brian Kelly, have talked with Seymour and his family about Seymour's interest in rejoining the team if he is readmitted as a student.

"CMU athletics feels it is in the best interest for all that Jerry pursue his football career at a different institution," Heeke said in a statement. "CMU stands by its belief that all student-athletes are held to a higher standard and are expected to represent CMU responsibly."

Seymour has been out of school for two years.

"It's rather unfortunate that they're taking that position," said Seymour's attorney, Jeffrey Edison. "Jerry would be an asset not only to the team but to the school itself."

Edison said he did not know what Seymour would do but said he would "do the right thing" to fulfill his sports and academic potential.

Alabama LB Simpson: I passed drug test 'right after' arrests

TUSCALOOSA, Ala. -- Alabama linebacker Juwan Simpson said he passed drug tests both before and "right after" his arrest for marijuana possession and other charges.

"And I'll continue to pass them, no question about it," said Simpson, adding that he has never been a drug user.

Simpson has apparently put his legal troubles behind him. A charge for possessing a stolen handgun was dismissed for lack of evidence and he agreed to enter a court-ordered drug treatment program to resolve the possession charge.

Now, the senior -- Alabama's only returning starter at linebacker -- is trying to focus on football again.

He was stopped by Bessemer police on May 20 for driving erratically and arrested for possessing a stolen handgun, carrying a handgun without a license and possession of marijuana.

Simpson pleaded guilty last week to the misdemeanor charge of carrying a handgun without a license, agreeing to pay $300 in fines and court costs.
Simpson is an academic All-Southeastern Conference pick who has already received a degree in financial planning. He is pursuing a second degree in criminal justice.

Crimson Tide coaches gave him the Derrick Thomas Community Award after spring practices, before his troubles started.

Simpson didn't go into details about what happened the night he was arrested.

"Pretty much I can tell you what everyone already knows," he said in an interview with the Tuscaloosa News.

Simpson denied using marijuana, and said he didn't know where in his truck police found the drugs.

"The thing that I feel I was completely wrong about was not having the pistol license," he said. "I wasn't doing drugs, I wasn't worried about that issue. What really concerned me was that now this is going to get out and everybody's going to think that I'm the bad guy. That's not me at all, that's really not my style."

He said coach Mike Shula hasn't told him whether he will face a suspension during the season.

"Whatever decision he makes, Ill be happy with it because I was the one to put myself in this situation," Simpson said.

Texas Tech player OK after stabbing

LUBBOCK, Texas (AP) -- Texas Tech safety Anthony Hines was in satisfactory condition at a Lubbock hospital Monday, two days after his sister said he was stabbed in the abdomen during a fight at a night club.
Hines, who is vying for a starting spot in the secondary, was scheduled to begin preseason workouts Aug. 7.

Lubbock police Lt. Roy Bassett said Monday that dispatchers got three calls early Saturday morning from a club. Police records showed no report of a stabbing and an investigation into the incident will be conducted, he said.

Hines' sister, Laquisha Hines, told the Lubbock-Avalanche Journal her brother had emergency surgery to repair a pierced colon a few hours after the night club fight.

She said that her brother and other Tech teammates were at the club when they became involved in an altercation.

Anthony Hines is a 6-foot-1, 230-pound sophomore safety from Denison, Texas. As a redshirt freshman last season, Hines played in all 12 games, mostly on special teams.

Texas Tech coach Mike Leach told The Associated Press on Monday that information he's received indicates there was a fraternity party at the club.

"All of a sudden the thing escalates and Anthony gets stabbed," Leach said.

Four UM players suspended for opener vs. FSU


University of Miami football coach Larry Coker announced Tuesday that he has suspended four players for the opening game Sept. 4 against Florida State.
Projected starting wide receiver Ryan Moore has been suspended for the first two games.
Running back Tyrone Moss, linebacker James Bryant and Rashaun Jones -- recently switched from cornerback to receiver -- will not play against FSU.
Coker said the suspensions were because of violation of team policy. He said the players knew about the suspensions before Tuesday, but he wouldn't elaborate.

Ex-Smyrna star waved gun, deputy alleges

KNOXVILLE — Tennessee Coach Phillip Fulmer said Monday he won't rush to judgment on any potential disciplinary measures for redshirt freshman defensive back Marsalous Johnson.

The former Smyrna High star was arrested Sunday night and charged with felony aggravated assault after an off-duty Putnam County Sheriff's Department deputy said Johnson waved a pellet gun at him on Interstate 40 near Monterey.

Redshirt freshman linebacker Rico McCoy was also in the car with Johnson, according to police records, but was not charged.

"I want to find out more about what happened, see what's true and what's not and go from there," said Fulmer, whose Vols open preseason practice Friday. "We've had very few distractions this offseason, and we're not going to let this be one."

The sheriff's deputy who accused Johnson of waving the pellet gun, Mike Hoover, is also a Tennessee Wildlife Resources Agency officer and was on his way home from a shift as a boating officer at Center Hill Lake when the incident occurred, said Dan Hicks, the TWRA Region 3 public information officer.

Hicks said Hoover had his nephew in the car with him when Johnson pointed what appeared to be a gun at them.

"You've got inches of space between the vehicles, and then in addition to that, somebody's pointing what our officer deemed to be a gun," Hicks said. "Anyone under those circumstances would have felt threatened."

Hicks said Hoover, who was in a private vehicle but wearing his TWRA uniform, tried unsuccessfully to get Johnson to pull over and then communicated with another on-duty sheriff's department deputy, who was able to intercept Johnson. Hoover was at the scene at the time of the arrest.

Hicks said Johnson initially denied to police that he had a gun, but that a search of his car produced a plastic Uzi pellet gun under the passenger seat.

Johnson later admitted that the pellet gun was his, although he said he forgot it was in the car, according to police.

Johnson told coaches and teammates that Hoover was refusing to let him pass. Johnson told police that Hoover was slamming on brakes and trying to get him to rear-end him.

According to police records, Johnson also admitted that he pulled alongside Hoover's truck, rolled down the window and yelled.

Both Johnson and McCoy were handcuffed and placed in the back of the police car. McCoy denied any involvement and was released.

Johnson spent the night in jail before posting $10,000 bond and being released Monday. Johnson appeared in court on Monday, and the case was continued to Sept. 6.

His mother, Patricia Fayne, declined to comment other than to say, "I know my son is not like that, and anybody around here knows he's not like that."

Fayne said the family has retained an attorney.

Fulmer had placed his players on a zero-tolerance policy following the May arrest of senior linebacker Marvin Mitchell on disorderly conduct charges. Mitchell remains suspended, although Fulmer said at the SEC Media Days that he expects Mitchell to be back for the Sept. 2 opener against California.

Fulmer also dismissed redshirt freshman defensive lineman Raymond Henderson from the team for what Fulmer called an inappropriate comment Henderson made to an adolescent girl. n

USC's Brandon Ting tested positive for steroids

USC safety Brandon Ting tested positive for steroids last winter and would have been ineligible this season before deciding to quit the football team with his twin brother, Ryan, according to multiple sources.

According to an NCAA official, players who test positive lose one year of eligibility and are held out of competition for one year. The penalty cannot coincide with a redshirt year.

Brandon Ting was going to be a senior. He practiced last spring and would have been eligible to practice this fall, as long as he did not play in games.

Brandon Ting could not be reached for comment. Last week, Ryan Ting released a statement when the brothers announced they would no longer play football to concentrate on the demands of their medical school ambitions.

According to a school spokesperson, the brothers are enrolled in a post-baccalaureate program for medical school.

"For the past three-and-a-half years, Brandon and I have been able to balance the demands of football and academics," Ryan Ting said. "Now, as our focus turns toward medical school, we realized it was in our best interests to end our playing careers.

"We realized we couldn't balance both if we want to be serious about med school. While it is difficult to leave our teammates, we know that they and the talented incoming recruits will have great season in 2006.

"We appreciate the opportunity that Coach (Pete) Carroll gave us, we value the fact that we were part of some special times at USC."
Carroll could not be reached for comment.

Ryan Ting was slated to be USC's No. 1 punt returner this season before quitting the team. Brandon Ting played in all 13 games last season and intercepted one pass.

Their father, Dr. Arthur Ting, is a prominent Bay Area physician who treated Barry Bonds for his knee injury in 2005. According to the San Francisco Chronicle, Ting was subpoenaed to appear before the grand jury in U.S. District Court in the federal investigation of Bonds.

Oklahoma football coach Bob Stoops says he's dismissing two players from the Sooner football team.

A news release from OU does not name the players, but News 9 sports director Dean Blevins says one player is starting quarterback Rhett Bomar.
The release says an investigation by the university found the two players were paid to work at a private business and were paid for hours they didn't work.
OU said the two are being permanently dismissed and will not be allowed to return to the team at any time.
OU athletic director Joe Castiglione says he's disappointed in the athletes and university President David Boren says he believes Stoops is doing the right thing and he strongly supports the coach.

NORMAN, Okla. -- Based upon an investigation initiated by the University of Oklahoma and facts uncovered by the University, Head Coach Bob Stoops today announced that he has permanently dismissed two members of the Sooner football team.

The investigation by OU revealed that two football players received extra compensation above that to which they were entitled related to their employment at a private business. This is a direct violation of NCAA rules. The two accepted payment over an extended period of time in excess of time actually worked. OU is taking the initiative by declaring them ineligible for the entire current season and by permanently dismissing the two from the team. They will not be allowed to return to the OU team at any time in the future.

“We spend a considerable amount of time addressing our players regarding their personal conduct and the NCAA rules,” Stoops said. “They know exactly what we expect from them. Ultimately, they have to make right decisions. The same holds true for our boosters. When they do not, the consequences are serious, and we will not tolerate this behavior.

“Our team and University actions are necessary because of the intentional participation and knowledge of the student athletes in these violations,” Stoops said.
“I firmly believe that our program is stronger than any individual player and that a championship program cannot compromise its values,” he said. “We are proud to represent a University with the highest possible principles,” Stoops said.

"I strongly support the decision of Coach Stoops," said OU President David L. Boren. "Coach Stoops has done the right thing. His action reflects the basic values of our University,” Boren said. “While this situation is deeply disappointing, the University is sending a clear and unmistakable message that OU will never compromise its high ethical standards or its integrity. We share the sadness about this situation with our fans and players who have followed the rules, but we believe in our program and in this team, which we know will carry on in the great Sooner tradition.”

Athletics Director Joe Castiglione said, “I am disappointed in these student-athletes. The education process is something that we take very seriously. We talk about it frequently and include guidelines in many of our printed materials. In the end, individuals must decide right and wrong for themselves and then live with the consequences. Unfortunately, many more people who themselves play by the rules are also affected by these consequences.”

Freshman TE Smith charged with drunken driving

KNOXVILLE, Tenn.
-- Tennessee freshman tight end Lee Smith was arrested Wednesday morning on campus and charged with drunken driving, making him the fourth player on the team to be arrested since May.

The Volunteers, coming off a 5-6 season, begin practice Friday. Smith is the second player to be arrested this week.

A star player from Powell High School, Smith was arrested after a university police officer saw him driving on the sidewalk, according to an affidavit of complaint obtained Wednesday by The Associated Press. He failed four field sobriety tests, the report said.

Smith refused to take a breathalyzer test and was taken into custody. Bond was set at $500.
