Central Florida Man Drinks Soda Contaminated With Urine

DELTONA, Fla. -- A Central Florida man is worried that his health is in danger because someone put urine in his soda as a malicious prank. The man is still waiting for the results of numerous health tests.
Publix, the company that owns the store, admitted the soda they sold was contaminated. The victim bought the tainted soda at the Publix-owned Pix convenience store at the corner of Elkcam and Howland in Deltona. That is where a construction worker said he bought and drank part of a Mountain Dew that was actually filled with an employee's urine.
"Got about half way through it and noticed that something wasn't right. I started vomiting all over my truck, started vomiting all over in the parking lot. I just couldn't control it, just nonstop vomiting," the victim said.
The man, who Channel 9 has agreed not to identify, received very bad news Tuesday. He said tests done by Publix confirmed his worst fear.
"I did find out what was in the bottle. It tested positive for urine and I had to call them to find out. They wouldn't even call me to tell me what was in it," he said.
The man bought the drink about two weeks ago and at first didn't realize what was inside the bottle.
"I went back inside and the manager told me it was just bad syrup," he said.
But later, an employee at the store called the victim to say a disgruntled co-worker had tampered with at least one soda bottle.
"He went in the back. He opened the bottle, urinated in it, put the cap back on and put it back on the shelf," he explained.
Now, the man's biggest fear is what might he contract.
"Our concern, obviously, is the health and welfare of this young man. He absolutely could have contracted HIV, gonorrhea, herpes," said attorney Dan Newlin.
"I'm just very concerned ... and how many other bottles did he do that to?" the victim questioned.
A local doctor told Channel 9 that the urine in the bottle could easily transmit diseases.
A Publix spokesperson said the employee admitted to urinating in the bottle and was suspended. They would not release his name and the supermarket chain did not contact law enforcement.
"We want to make sure our customers know that they can come into any of our Publix locations or Pix locations and be assured their product is safe for them and their families," said Publix spokesperson Dwayne Stephens by phone on Tuesday.
The victim said Publix was not responding appropriately.
"I'm very angry and it's hard for me to control. I'm just trying to stay civil and do the right thing and I think this man should be put in jail for it," he said.
Publix said the employee admitted to tampering with only one bottle of soda. He apparently worked in the deli area for about four years.
Product tampering is very illegal, but Publix did not call law enforcement. Tuesday, Channel 9 did.
Also Tuesday, Channel 9 did some investigating and found that this kind of product tampering is a felony under federal and state laws, punishable by up to 40 years in prison.
The victim in the incident was administered a battery of tests Tuesday to determine if he may have contracted any diseases. His attorneys were filing suit against Publix to obtain evidence in the case.
