PORT ST. LUCIE ? A planned trick on a friend involving a bag of parsley turned into an arrest for a 15-year-old local boy, according to a police report released Monday.

The 15-year-old boy and a 13-year-old boy told police Friday morning they were headed to another friend's home. At the time, they were walking across Crosstown Parkway during school hours.

The elder boy said he was going to play a trick on his friend. He said he had a bag of parsley that he was going to make his friend think was marijuana. The parsley, which he got from his kitchen cabinet, was in a clear plastic bag and appeared similar to pot.

The last time the boy smoked marijuana allegedly was the day before.

The 15-year-old boy was arrested on a charge of possession of a counterfeit controlled substance with the intent to deliver.

I'm assuming the intent of that law is to stop folks who try getting around normal drug trafficking charges by technically selling things that aren't drugs under the guise of them being drugs. Then again, a "counterfeit controlled substance" should actually mean something like knockoffs of subscription drugs, etc., and not a cooking seasoning disguised as pot.

Yeah, I guess I can see that, but it still seems rather idiotic to me. Having nothing illegal, but it looks like it's illegal, so there's a reason to arrest the kid. Remind me not to go storing my flour in ziplocks baggies, "No, honest officer, I was just going to use it to make gravy!"

Yes it's a stupid law but it's just meant to close a loophole.

Remember we're talking about attorneys here...wording the original law so that selling what are believed to be drugs (whether they are or not), is too great of an intellectual leap.
