I've Been Turned Over To Collections

Amazingly enough, when dealing with this shit, the 2 things determine responsibilty for this shit is NAME AND ADDRESS. SS# is the last thing they look at. Date of Birth is also a determining factor.

I went to open a checking/savings account and they told me I couldnt due to the fact I had a foreclosure and repo on my credit. I looked at the dumb ass and said, I just turned 18, and the only bank dumb enough to give a kid a mortgage would be this bank. Then she asked me to write a letter explaining this.......explaining I just turned 18 and couldnt have bought a house???? It took about 4 months to get that resolved.

Send a response (certified) to the collection agency that says, "I dispute the validity of this debt." My understanding is that will bar them from doing anything that damages your credit report (at least until the dispute is resolved). I think you have 30 days to do this.
Actually.....

Send a response via certified mail as HineyBuck mentioned. Tell them that you are disputing the claim and that under the Fair Debt Collections Practices (something like that..look it up online) they have 30 days to show proof of their claim. If they cannot show proof within 30 days they are required by law to stop trying to collect the debt from you and it must be taken off your credit report.

I used to be a receptionist in a collections law firm (long time ago) and my mother works for said law firm to this day. I had my mom help me write up a document that had the laws and stated what I mentioned up top. They couldn't prove the debt so they had to remove it from my credit report.

I would google Fair Debt Collection Practices Act to see if you can find any information. You could also do a search for disputing collections which will turn up some good information.

Unfortunately because of the time factor it won't help you on your credit RIGHT now but....

Edit: Proof that they are required to show is something with your signature on it that is basically stating that you owe this debt. In my case it was a lease agreement for an apartment (which I never signed one so they didn't have proof). For credit cards it can be the application and/or signed credit card slips. Hospital bills, maybe a release agreement for them to treat you or something like that.

This is ridiculous. I went today to pick up a new suit at a small shop here in my small town. The salesman asks me if I had some pants tailored as well. I told him just the suit. They belonged to someone with the same name.

On the good side, I was approved for the mortgage today without incident. Hopefully I will get this health bill straightened out soon.

You guys pickin up the trend? It's ALWAYS the other guy... first it's the hospital people's fault.. then it's ANOTHER hospital's fault... then it's the tailor's fault... I dunno.. after three times... one has to wonder who's the nutty one

Wait till the mortgage broker realizes he has multiple personalities too.. and that he's skippin town... go figure

One of my customer's is John Smith and he does not have these troubles.
You can run but you cannot hide. It might be easier just to submit this to your insurance.

I thought about paying it myself. I'll see what tomorrow brings. The health insurance company is supposed to be getting the original bill from the hospital. I'll be curious as to what that reveals.
