not legal advice, but...

i would think that if you were just given a citation for battery, hiring a lawyer could probably get it reduced to some minor misdemeanor like a disorderly conduct ticket or something. lawyers always have a way of getting relatively minor charges reduced significantly.

I dont think so. I didn't hit him that hard. I gave him a good solid jab, like someone said above, just to create sepeartion. Afterwords I was told he was knocked down and after a couple seconds he got up wobbly and then he took a piss. The dude was out of control and drunk as shit. But I can't imagine he has any real damage.

No ambulances were called. I have more injuries from when I slipped/was tripped. My hand is half scraped off from sliding on the pavement and bracing myself. If I never slipped/got tripped this would not be happening because I would have made it home before any cops were around. Although just my luck another, bar fight occured right next to the bar we were at.

Go get a free consultation. You have a better chance that a lawyer can get it reduced than getting off completely because evidence of him being unruly earlier isn't quite the same as evidence of him pushing you.

First, as mentioned by others, hire an attorney.

Second, file battery charges against the pudgy guy immediately. This will be better evidence that you were indeed pushed by him first, and that you acted out of self defense.

Where did this take place (city, state)? Then, what provision of law is cited on your court summons, or whatever it is the cops gave you?

Also... keep in mind that whatever you spend will be worth it if you get this case tossed or the cahrge reduced to.. say a disorderly conduct.

I do not want to be an advocate for lying in court, however if you changed your story to "he called me Tibor" you may get a little more sympathy from the judge.:wink2:

Why didn't you hit him hard? I'm hoping the good solid jab was executed with a closed fist or the initial insult (as another poster pointed out) might be looked at as a nickname.

I've had a few experiences in this situation and highly recommend throwing a hard first punch that hopefully intimidates the others into not kicking your ass (blood helps/not yours). Granted I didn't execute well many times and the enemy began the counter attack, at this time it is best to take the battle to the ground. On the ground I've found that once defeat was obvious - covering the facial area via the fetal position works best until good samaritans or the authorities bail you out. If you've got the balls to throw the first punch, don't run or you are a vagina.

I can tell you this, each time I found myself throwing punches in hindsight I wish I would have walked away. I was never seriously hurt and I never did much harm to anyone else but I have seen a couple stupid fights result in serious consequences - both medical and legal.

Where to start, where to start....

First, get a real legal opinion. Even if it's just a free opinion from a university or clinic type thing, it will help, as any cabable attorney will be able to ask a multitude of clarifying questions, and then give you legitimate advice.

Second, and this is very important, you need to find people that saw what happened. It will be significantly helpful to you if you do not know them in any way, save that they witnessed either (A) the guy getting thrown out, (B) the guy provoking others, or (C), this guy pushing you. His friends may or may not testify for him. If they do, and they lie, chances are high they will get caught lying. Besides, they are his friends. Your witnesses will be people you've never even seen before. Likely the best people for this will be the employees that were working that night, as they will not have been drinking (hopefully), and will be construed by the judge to be completely unbiased.

Third, obtain the police report immediately. It would not be a bad idea to file charges against this guy, but you need to see what the cop reported. He may not have seen you get pushed, but the report may say "I observed 4 people exit the bar. While they were walking, they appeared to have some type of conversation with a fifth individual. One of the five turned around, and the fifth individual struck him." This would significantly hurt your case.

Most importantly, consult an attorney.


This whole story actually reminds me of my night last night. I was out with some friends, when some asshole at a pizza stand called my friend a jackass. I turned around and shoved him so he would know he can't get away with that shit, and then the little vagina punched me in the mouth before running away like a little girl. I was gonna chase him, since he hits like a girl too, and it didn't hurt, but then the cops showed up so I had to bail. I'm gonna find that kid, though, and get him good. :wink2:

JC is right... if you would've knocked the motherfucker out with the first punch his buddies wouldn't have wanted anything to do with you. It also helps if the persons head bounces off the pavement or they land face down and knock a couple of teeth out, that way there will be a lot of blood and the friends will be scared. Believe me, I have plenty experience with these tactics.
