Droughns obviously wasn't out on a binge by any means. For his size, he probably had about 5-6 Beers in a 3-5 hour time frame. Tolerence has nothing to do with your BAC, tolerence is simply how you "handle" your booze. A seasoned 165 pound power-drinker can kill a 6-pack in an hour, be at about a .12 and you'd never know he had a drink. A less experienced fella of the same weight, dinking that same 6 pack in an hour will also register a .12, but will be staggering and bouncing off walls.
I saw the dashboard video on the local news last night, and I'll assure you that Droughns is NOT a regular "drunk." At .08, he didn't look real sturdy and was overly cautious in "walking the straight line" which he didn't perform too well. His was at the limit, and will be convicted. No wreckless operation here, that was 25 years ago. Being legally impaired is plain and simple, just like you can't be "a little pregnant." Murder is murder, whether you shoot a guy one time or 50 times.
