We’re such a litigious society that I can see the potential for it. I would say there was a lot of ignored compliance.
Absent willful transmission (e.g. purposefully coughing / spitting on someone), I think it will be difficult sledding to convict in the case of a criminal charge or in the favor of a plaintive in a civil suit. With a criminal charge I think that reasonable doubt would be pretty easy to establish (“I didn’t know I was sick” or “I didn’t have a temp...” or even “prove it was me...”); for a civil case I think you’d have to demonstrate intent and damages... damages being the easier of the two.
But yeah, litigious society that we are, it ain’t gonna stop the suits from being filed.
That said, if anything is uncovered suggesting that data at the state or federal level was knowingly withheld or misrepresented, into the fan the shit will be thrown. I’m starting to see some noise around the (implied willful mis)representation of data in Ohio...
