Another idiot suing McDonalds...

Unreal. first she doesnt realize that police don't do strip searches outside the Police dept. This after she should have asked to see ID.
Secondly she didn't know that strip searches on females are only done BY females.
And three, that they sure as hell don't take 3 hours. Why doesn't she sue her parents for not teaching her. Oh wait the parents will blame the school system

It's incredible what a "normal, average, human" will do when told to do so by "authority."

Read up on the Milgram experiment and see what I mean.

It's theorized that this human tendency was a large part of how easy it was for so many to be deceived by so few into taking active part in reprehensible acts in the concentration camps of WWII Germany.

I know all about that human trait. I use it a lot when I window peep and/or get caught after breaking in while smelling the panties women take off at nite, or are still wearing as the case may be.
Anyway her suing for her stupidity is stupid

wow... the rampant stupidity in this case is amazing. no officer, no badge, no angry customer looking for lost belongings, and an assistant manager who honestly thinks they have the legal authority to strip search someone? are you kidding me? what on earth is wrong with people? well, some guy on the phone who says he's a cop told me to shoot you in the face so... sorry about this but...

hate to say it but she has a legit case and will likely win something. don't think mcdonalds should be paying the large share. but it did happen on their property and was performed by officials representing their company. so they are certainly going to be held responsible to a degree.

During the trial, jurors watched more than an hour of a security video of the hoax call. On the video, a nude Ogborn is shown performing sex acts on herself and Nix.

ya know, at some point you probably have to stop and ask the officer how her coating herself in a chocolate chip mcflurry is going to help in finding a lost purse. certainly not during of course, ya know... sometime afterwords.

on a side note, we have a hot new intern working the front desk... im feeling a lost phone strip search in the server room coming on...

ignorant people and their dignity/money/life are soon parted.

Why isn't there a law that fines attorney's for bringing lawsuits deemed "frivolous" by judges.

Here in lies the problem with our judicial system. The judges very rarely ever deem a lawsuit frivolous and "throw it out".

I think this lack of action is called the "make more money for the lawyers policy" in the judicial/legal profession. :biggrin:

im not entirely certain this one is truly frivolous though. unlike a certain i bought something from you and spilled it on myself so its all your fault dolt. my understanding is the assistant manager assisted in strip searching this girl. the only cause for doing so was someone claiming to be a police officer over the phone. sure, the girl was 18 and absolutely has 50% of the blame if not more. but while the 18 yr old should have known better, the assistant manager most certainly should have as well and willingly took part.

let me see if i got this straight. we as a society can control hunks of metal weighing up wards of 6,500 lb's moving at speeds in excess of 70 mph literally feet from other persons with a cell phone all but permanently attached to our skulls. but when someone calls you claiming to be a member of law enforcement acting with your managers approval and instructs you to take part in a felony. you can't be bothered to pick up your phone to contact someone not the person on the line for clarification?

1. This case isn't even close to frivolous.

2. There is such a rule: FRCP 11

b) Representations to Court.
By presenting to the court (whether by signing, filing, submitting, or later advocating) a pleading, written motion, or other paper, an attorney or unrepresented party is certifying that to the best of the person's knowledge, information, and belief, formed after an inquiry reasonable under the circumstances,--
(1) it is not being presented for any improper purpose, such as to harass or to cause unnecessary delay or needless increase in the cost of litigation;
(2) the claims, defenses, and other legal contentions therein are warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law or the establishment of new law;
(3) the allegations and other factual contentions have evidentiary support or, if specifically so identified, are likely to have evidentiary support after a reasonable opportunity for further investigation or discovery; and
(4) the denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on a lack of information or belief.
(c) Sanctions.

If, after notice and a reasonable opportunity to respond, the court determines that subdivision (b) has been violated, the court may, subject to the conditions stated below, impose an appropriate sanction upon the attorneys, law firms, or parties that have violated subdivision (b) or are responsible for the violation.

I think that the girl is deserved some money.

The dumbest person in this case is the idiot woman who actually answered the phone and made the girl strip, following all of the instructions of the "officer" on the phone. She's the biggest fucking idiot. That young girl deserves some money, $200 million? Nope, but a couple of million she's definitely due.
