A comment was made about the state court judge delaying her TRO decision to foreclose the ability of the Big 10 to remove the case to federal court. I was simply expressing why I believe federal court is not an option.
There is no way to get the case into federal court. The underlying claim is state law contract action eliminating federal question jurisdiction. As for diversity jurisdiction, the Bd of Regents are an arm of the State and are considered a State for diversity purposes. States are not citizens...
According to the court docket a decision has not yet been filed in the court. My guess is there have been enough commercial contacts by the Conference in the State of -ichigan to subject the Conference to the court's jurisdiction. The problem the judge is having IMO is the 13 page letter sent...
This is what I get for listening to drunk weasel fans. When asked the judge's name, the name given is Timothy P Connors, a state court judge sitting in Washtenaw County. https://michigan.law.umich.edu/faculty-and-scholarship/our-faculty/timothy-connors
Apparently Michigan filed a TRO request in the Federal District Ct. for the Eastern District of Michigan. The judge is supposed to announce his decision later this evening or early tomorrow at the latest. Weasels feel confident. We'll see.
I would love to hear Mars trying to convince a judge that his client would likely prevail on the merits and is therefore entitled to a TRO given what was disclosed tonight in the 13 page letter.
