For immediate release:
The State College Police Department has concluded its investigation into an event that was recently broadcast on a popular internet personal video sharing site. The video clip captured an event that occurred on Saturday, October 27, 2007, at 417 E. Prospect Avenue in the Borough of State College. The video depicts a victim being pelted with beer cans as he walked through an outdoor fraternity party. Based on evidence gathered from the online video clip and corroborated by the victim and witnesses at the party, summary charges have been filed in connection with the case.
In citations filed today before Magisterial District Judge Carmine Prestia, Richard Eisenberger Jr., age 20, of Easton, PA, was charged with Disorderly Conduct and Harassment. The information charges that Eisenberg, a University of Pittsburgh student, did strike the victim with a beer can about the neck and that he also created public inconvenience, annoyance or alarm by engaging in fighting or tumultuous behavior. The victim, a 21 year old Ohio State University student, reported receiving a minor bruise to his neck from the attack. The injury did not require medical treatment.
Additionally, the fraternity, Pi Kappa Alpha, at 417 E. Prospect Avenue, has been charged with the summary offense of Disorderly Conduct as host of the party that resulted in the disorderly and unlawful behavior displayed by many of its guests.

rticle V: Code of Standards
A. General Statement:
We, the men of the Interfraternity Council of Washington University, recognize and accept the statement of Fraternity Criteria of the National Interfraternity Conference as our guidelines regarding the standards which we set and maintain for ourselves.
B. Alcohol:
The possession, use, and /or consumption of alcoholic beverages, while on chapter premises, during and official fraternity event, or in any situation sponsored or endorsed by a fraternity, must be in compliance with any and all applicable policies of Washington University.
C. Personal Conduct
1. The Interfraternity Council recognizes and accepts the Resolution of Human Decency of the National Interfraternity Council as our position on the issue of personal conduct.
2. Using, or threatening to use, physical force or violence to harass, abuse, coerce, or intimidate another individual will not be tolerated.
3. Disorderly conduct tarnishing the reputation of the Greek system, on or off campus, will not be tolerated.
D. Hazing
1. The Interfraternity Council recognizes and endorses the Resolution against Hazing of the National Interfraternity Conference.
2. No Chapter, nor any of its members shall conduct hazing activities. Hazing activities are defined as follows: ?Any action taken or situation created, on or off fraternity premises to produce mental or physical discomfort, embarrassment, harassment or ridicule. Such activities may include but are not related to the following: forced use of alcohol, paddling, the wearing of public apparel which is conspicuous and not normally in good taste, engaging in public stunts and buffonery, morally degrading or humiliating games and activities, late work sessions that interfere with scholastic activities, and any other activities which are not consistent with fraternal law, ritual, or the regulations and policies of Washington University and the
Interfraternity Council.?
Pi Kappa Alpha National Fraternity is determining what action may be taken against the fraternity, and Penn State’s Office of Fraternity and Sorority Life temporarily has suspended Pi Kappa Alpha chapter activities, Penn State announced Wednesday.
Joe Puzycki, director of judicial affairs at Penn State said only individual student misconduct is reviewed by judicial affairs.

A University of Pittsburgh student who police say was videotaped pelting beer cans at an Ohio State student Saturday was charged Thursday with two summary citations.
Richard Eisenberger Jr., 20, of Easton, was issued a citation charging him with disorderly conduct and harassment after a video surfaced on YouTube.com that captured him in the act.
In a press release issued Thursday, State College police Sgt. Keith Robb wrote that as a result of Eisenberger?s actions, the 21-year-old Ohio State student received minor bruises to his neck about 4 p.m. at Pi Kappa Alpha fraternity?s outdoor tailgate party. Those injuries did not require medical treatment, he wrote.
