This was one of my first thoughts, too. I have not read any of the reports yet - what was Flemming's BAC level? I imagine he will have a hard time forgiving himself like @muffler dragon posted, this story just sucks.

I gotta say, this seems like bullshit to me. Yeah, driving an ATV without a helmet and after drinking wasn't very bright, but "assault"? "Aggravated homicide"? Isn't that bit much? It was an unfortunate accident not a fucking crime. Sounds like someone is interested in a payday.

All things considered, probably fair. Deserves some time for a reckless decision but he will feel his real punishment the rest of his life no matter what - the loss of his girlfriend.
I hope this is not something that derails his life and he’s able to find some peace and good doing in his future.

Jail probably feels like nothing considering the guilt he has to feel.

Can't imagine how I would feel if it were one of my daughters. Can't imagine how I would feel if he were my son. Just a sad thing and a reminder to everyone to not mix driving with alcohol (and without a soapbox as I did the same thing in my youth).
Something not being mentioned is context. If the deer came out of nowhere, I'm not sure sobriety would have been that much of an issue.
