A Centreville woman claimed in a suit filed Wednesday in Madison County Circuit Court that a bird attacked and seriously injured her while she was shopping at a hardware store in Alton.

Rhonda Nichols, 40, alleges in the suit that a bird flew into the back of her head while she was at the outside gardening area of the Lowe's Home Center, 1619 Homer Adams Parkway.

Nichols is seeking damages against the store in excess of $50,000.

According to the suit, filed by the St. Louis firm of Anderson & Associates, the store "allowed wild birds to enter the Gardening area in which customers travel ... Nichols claims the bird caused injuries to her head, brain, neck, muscles, bones, nerves, discs, ligaments, as well leading to the loss of neurological functions and cognitive skills.

Her attorney, Zane T. Cagle, said "the bird was described to us as being about the size of a robin or pigeon."

"This was no sparrow," Cagle said.

The attorney said his client has since returned to work but declined to say where Nichols was employed.

Nichols could not be reached for comment.

The suit said the incident occurred "on or about April 15, 2003." Bobbi Rose, an assistant manager at Lowe's, said the store had no record of any human-bird collisions on that date.

"It's an outside garden area," Rose said. "What are we supposed to do? We have no control of the birds."

Cagle said the incident was part of a larger problem.

"These wild birds are an issue in many of these types of stores," he said.

This is the most idiotic thing... looks like it also caused her to have to file filoneous law suits.
 
As punishment for this frivolous lawsuit, she should be locked in a room with bread and water, and forced to watch Hitchcock's The Birds for an entire weekend.

C'mon guys... at first I thought this was laughable, too... but it was THE SIZE OF A ROBIN! Gheesh, give the poor woman a break.

I guess she's lucky it didn't snatch her up and fly off with her!

I hear that at garden centers that sell flowers there have occassionally been bee sightings. No, really! And not just little sweat bees, but those big honey bees and monstrous yellow jackets and bumble-bees, too! Who woulda thought?

If the store put up a mesh screen to protect the customers and the birds smashed into it and killed themselves this lady would have sued them for robin-cide. I wonder how she would deal with real adversity?

Real simple solution to these dumbass cases.

If you sue someone and lose, you pay the legal fees for BOTH sides, instead of just shrugging your shoulders and going home. If this chick wants to bring Lowe's into court, she'd better be prepared to pay their lawyers for their time. I'm guessing the injuries to her head, brain, neck, muscles, bones, nerves, discs and ligaments would suddenly improve dramatically.
