Jury Recommends Capital Punishment

4:49 p.m. Update: Jury recommends death penalty for Scott Peterson.

REDWOOD CITY, Calif. (Dec. 13) - The jurors deciding whether Scott Peterson should be executed or spend life in prison for killing his pregnant wife reached a verdict in the trial's sentencing phase Monday, a court official said.

The decision came on the third day of deliberations and after the jury requested autopsy photos and other evidence that had been presented during the guilt phase of the trial.

After the jury broke for lunch, a court administrator told The Associated Press to ''tell everyone we're having a verdict at 1:30.''

Earlier Monday, jurors had asked to review 13 pieces of evidence, about half of which remain under seal. They asked to see aerial photographs of San Francisco Bay and the widely publicized picture of Laci Peterson wearing a red maternity pantsuit with her hands folded across her lap.

It was not immediately clear what the rest of the evidence was, although 12 of the items requested were presented by the prosecution at trial.

The autopsy photos were shown to the jury during trial but remain out of public view. The aerial photographs and the candid picture of Laci Peterson, taken during a Christmas party shortly before she disappeared, are public.

Jurors debated about three hours Monday after taking the weekend off following 8 1/2 hours of deliberations last week. The judge will formally sentence Peterson on Feb. 25.

The same jury of six men and six women found Peterson guilty Nov. 12.

Defense attorneys called 39 witnesses over seven days in the penalty phase of Peterson's double-murder trial. Prosecutors called just four of Laci's family members, all on the first day, Nov. 30

The 32-year-old former fertilizer salesman was convicted of first-degree murder in the death of his wife and second-degree murder for killing her fetus. Prosecutors say he strangled or smothered Laci Peterson on or around Christmas Eve 2002 and dumped the body in San Francisco Bay.

The remains of Laci Peterson and the fetus washed ashore about four months later, just a few miles from where Peterson claims to have gone fishing alone the day his wife was reported missing.

If jurors are unable to agree on a sentence, prosecutors must decide whether to retry just the penalty phase or to accept a default sentence of life in prison.

It couldn't have happened to a more deserving guy.

The only thing that bugs me about the death penalty (besides the endless appeals, dragging out the sentence....) is that the person put to death frequently gets a much more peaceful ending than their victims.

Peterson brutally murdered his wife, but he'll probably get a nice little injection and drift off to sleep. Tim McVeigh blew up 163 people, and he got a nice little injection, peacefully drifting off to sleep.

I think that people sentenced to death should die in the same manner that they used to kill their victims.

I'm a little surprised to be quite honest the case against him... while compelling... was largely circumstantial... I tend to think this either get commuted to Life in Prison on appeal... (Which would be the easiest way to "take care of things" from DE's perspective... I'd say throw him into General Pop, and let things sort themselves out) Or we're going to end up spending death row money to house this dude for the rest of his natural life.

I think he's in BIG trouble (or at least his anus is), unless they keep him separated for the duration of his time before death (which will be like 15 or 20 years, if the judge even assigns the death penalty).


Couldn't have happened to a smellier armpit...good riddance.

Well, CleveBucks beat me to it. I wouldn't hold my breath waiting for this execution to ever happen, unless carried out by another inmate.

again....as i/we said the first time.....we wont try to get a guilty individual off based on race and blackmail....we trust the system....

Hilarious that something this irrelevant actually leads the news stories. I thought after 9/11, the American public wouldn't care about stuff like this? No doubt the American public is still ignorant enough to care...and still ignorant enough to not know where Afghanistan is on a map.

agreed. hardly newsworthy in my opinion. people get killed every day. it wouldn't suprise me that a husband kills his pregnant wife damn near every week in this country. yet somehow this is news. news would be a week when nobody kills their wife or unborn child.

on a related note, i can't believe this guy was literally a fertilizer salesman and was trying to sell that line of bullshit to the courts. unreal opportunities for comedy there.
