I think the judge is Mark Mallory's (Cincinnati's mayor) brother. So the judge is probably liberal and I don't think it really has that much to do with separation of church and state. It's just a funny sentence for a bastard.

So he got to choose between praying with black people, or getting raped by black guys. Good choice. Jail wouldn't do anything for his racism.
