Robert Gomez, a seventh-grader at Liberty Middle School, said he picked up a rubber band at school and slipped it on his wrist.

Gomez said when his science teacher demanded the rubber band, the student said he tossed it on her desk.

After the incident, Gomez received a 10-day suspension for threatening his teacher with what administrators say was a weapon, Local 6 News reported.

"They said if he would have aimed it a little more and he would have gotten it closer to her face he would have hit her in the eye," mother Jenette Rojas said.

Rojas said she was shocked to learn that her son was being punished for a Level 4 offense -- the highest Level at the school. Other violations that also receive level 4 punishment include arson, assault and battery, bomb threats and explosives, according to the Code of Student Conduct.

The district said a Level 4 offense includes the use of any object or instrument used to make a threat or inflict harm, including a rubber band.

Rojas plans to fight the ruling but her son still faces expulsion.

"It's ridiculous, it's a rubber band," Rojas said.

The school's principal could not comment because the case is still under investigation.

A district spokesman said there is still a series of meetings the district will have before Gomez is officially expelled.

Calmer than you are.
The kid's name is Gomez and his mother's name is Rojas. Therefore, he is obviously a juvenile delinquent, and should be treated like a criminal, regardless of what weapon he is brandishing.

Oh, wait. I'm not crazy, or stupid. This is a b.s. suspension. First of all, I don't believe that the kid simply tossed it on her desk, but probably flicked it at her. At worst that is worth giving the kid detention. A 10-day suspension and possible expulsion is re-goddamn-diculous.

This just doesn't surprise me, zero tolerance. Kids getting suspended for asprin, expelled for rubber bands. In my day you wouldn've gotten whacks or detention or Saterday school. Some teachers are becoming such pussies, no offense Grad and Thump, but these guys lumping arson and bomb threats along with asault with a rubber band is just a bit out there.

If I was that sons father...I would walk into school... punch the teacher in the eye and ask her/him if THAT was equal to being shot with a rubberband.

If he said no - I would say then stop my kid from being slapped with a level 4 offense....ooooh scary....(what is this..some covert op school)

If he said yes - I would say "johnny - go ahead and sock mr. jackwad in the face - since you know...its "equal".


side note - I once threatened a teacher that if he didn't stop spitting on me while he was yelling at me in the hallway - I was going to kill him. He was this little midget man...came up to my chin when I was in 8th grade but took me in the hallway and proceeded to let me have it....spit flying all over.... I don't take that crap ... sorry.

    One of my teachers used to randomly boom out a word in the middle of a sentence and scare the crap out of all of us. Tremendous voice; the entire wing of the school would know if someone was drifting off. This is the same guy who once returned a paper to me with just NO!!! across the entire front...

    Wish I'd had a rubber band.
