This is most likely true...I would look into lawyer fees, and what that would be. If it's more than what you're going to make back, you could sue her to cover those costs too, however, like stated above, go to small claims court.

If her company and /or she get discharged in bankruptcy, there will be no claim to pursue in small claims court - or any oher court for that matter.

Don't think of it as an either-or deal. Once a discharge is granted, there is nothing else to pursue....unless you find an additional defendant who breached a duty to you.

Definitely don't send her an email thanking her for agreeing to book a much better cruise as an apology for making such a "heinous mistake," and then break into her house and book a month-long premium cruise on her credit card for whatever business still has one.

What he said. Once a bankruptcy court says that the person or company going bankrupt no longer owes the debt (a "discharge") - the other courts have to honor that court order...so you won't be able to sue her later for taking your money if a bankruptcy court has granted her a discharge and said "this debt is gone and you do not owe it anymore" (i.e. a "discharge")

If she files in bankruptcy court and you do not fight it when she lists you as one of her debts she wants the court to discharge - and the court lists your debt as discharged in an order - simply put she does not owe you anymore, and the fact that you did not fight it in bankruptcy court usually means you cannot fight in a local court later.

You can sue her, and she will just give that local small court judge a copy of the Federal bankruptcy judge's order that says the debt you are suing for has already been handled....and forgiven. Case closed, she wins.

All I am saying is do not ignore what is going on in the bankruptcy

Supposedly, you will be notified if you are listed as a claim by the person filing the bankruptcy. Some people might (the 30 of you) say one should send a letter demanding proof that she send the funds to the cruise line, and that if the transaction error was her fault, advising her that y'all have claims for the amount of money that you lost, and that y'all demand she notify her insurer of the claims, and that she and her company list your claims if they pursue relief in bankruptcy....

Update: Awesome travel agent lady is in jail.

Info since the last update: She closed her other locations (one was open for about a week) and started a new business under a different name.....except she isn't the owner, her daughter is. nobody can see though that move or anything :roll2:
