Lawsuit: Clinic Used Wrong Sperm

A couple can proceed with a lawsuit against a fertility clinic they filed after the wife gave birth to a daughter whose skin they thought was too dark to be their child, a judge has ruled.


Thomas and Nancy Andrews, of Commack, N.Y., sued New York Medical Services for Reproductive Medicine, accusing the Manhattan clinic of medical malpractice and other offenses. They claim the Park Avenue clinic used another man's sperm to inseminate Nancy Andrews' eggs.

Wow that would be a "Sticky" situation. I don't know what you would do. Imagine if that was you or a loved one in that situation that would be really tough. Usually I think people are dumb asses for suing people for stupid reasons but I can actually see the couple's point. That whole situation is F'd up.

One presumes that they can establish that it was the artificial insemination that led to the pregnancy . . . as opposed to Dexter St. Jock or some such.

BTW, greenies to the first person to properly attribute my "Dexter St. Jock" reference w/o a quick INET search (I'll take your word on it).

That's what I was thinking as well, because if I was said dude, and said baby came out a different color I am pretty sure that "oh the clinic must have fucked up" would be her reasoning, not mine :)

The couple says that they have been forced to raise a child who is "not even the same race, nationality, color ? as they are," the judge said in the ruling.
I can understand suing, because you certainly want medical facilities to be more carefully organized and operated than was apparently the case here. That said, one would hope that genetics wouldn't be a barrier to this child being 100% loved by the people who brought her into this world. All babies are perfect, after all.

I am, however, terribly curious as to how a sperm mixup affects the nationality of the child. Perhaps it's for the best that the baby doesn't have to cope with having 100% of her genes from her parents.

I would say the parents are entitled to child support plus some extra (from the doctor) for the emotional distress of finding out that their baby isn't entirely their baby. I can only imagine what they went through when that baby popped out. The only thing that would make it better is if the real dad was Lebron or something. :p
