Is it a crime to rob from drug dealers and then sell the goods? Apparently, yes.

Dayton Officer Arrested By FBI

DAYTON, Ohio -- A Dayton police officer is in FBI custody, accused of conspiring to commit home invasion burglaries of drug dealers and to sell the stolen drugs.

The officer was arrested Monday night, along with a former Germantown police officer.

Local and federal authorities met at the federal building in downtown Dayton Tuesday morning and explained what has happened.

Authorities said 33-year-old Richard Elworth and former Germantown officer James Gregory are both charged with conspiracy to possess and distribute a controlled substance and using a deadly weapon to do so.

Investigators said Gregory burglarized a home on Monday night while Elworth sat in his cruiser as a lookout in his uniform. Police said the two men were taken into custody a short time later.

Authorities said they have a recorded conversation between the two men discussing their plans.

Investigators said if convicted, the two could get 20 years on the first charge and up to five years on the weapons charge. Authorities said the two will be held in a county jail somewhere in the Miami Valley.

I wonder if they pulled any invasions in the past? It's not like the drug dealers could call the cops and complain. "Hey Mr. Offficer-man; this dude came busting into my crib, held a gun to my face and stole all my drugs. I swear I wasn't do any of 'em myself, I sell all the stuff I gits."
