For Men of Law: Personal Injury Case Question

Honey, Frank the Tank is not coming back
About 4 months back a woman ran a stop sign as I was heading through an intersection causing me to t-bone her, and I was going around 30-35 mph I would say.

I went to the hospital later that night because I started to feel some serious whiplash and was told I had a hairline fracture in a vertebrae in my neck. Got some pain pills and suffered some pain for the next 1-2 months but it only hurts now when I play pick up basketball or aggrevate it a lot.

I settled a couple months back with State Farm for my totaled vehicle and received 3 grand which was the market price for the car.


They are now attempting to get me to sign a form saying I won't pursue further action against their client, but they haven't formally offered me a settlement yet. I had a passenger in the car who didn't report any injuries other than general soreness the next day who just received a $500 settlement and was curious what you would expect them to offer myself, as I hear State Farm generally attempts to lowball you.

Thank you to those who beared with me on that and I would love any input!
 
Do Not sign anything..you are not required to do so. If she was at fault, then it is her responsibility for the actions and results. Talk to a lawyer if you feel there is any chance of further medical complications.

First - what I am about to tell you is not provided as "legal advice", it is not offered by me in a role as an "attorney", no attorney client relationship exists between us or will exist, and I cannot and do not practice law in your jurisdiction.

That said, if someone still feels pain after four months post-accident, common sense says that all of us should never settle our cases until we reach a point where we are totally healed. Once any of us settle, the fact that we may later find out that we need surgery or additional medical treatment will not matter. Settled is settled. State farm would be off the hook if six months later we found out surgery was indicated.

If I had back pain four months after being told that I had a fractured vertebra, I would want some recent CT/MRI scans done and read to verify what was still wrong with me - if anything. I would like to be armed with that medical information before I made any decisions that were permanent - as far as the financial settlement was concerned.

No need to make up some legal mumbo-jumbo....I think we all understand what took place here. :highfive:
