Ed O'Bannon suing the NCAA...

It's going to be interesting to see which current college player/athlete attaches themselves to the case/lawsuit, as instructed by the judge.

I was thinking Johnny Manziel, but that's probably not going to happen.

Current athlete can now join the O?Bannon case

The class-certification hearing in the Ed O?Bannon vs. NCAA case was held last month. While current athletes still have a while to wait before a ruling is made regarding their right to seek compensation, one of them can at least join the plaintiffs? complaint.

U.S. District Judge Claudia Wilken ruled Friday that a current, unnamed athlete can be added to the list of plaintiffs in the case. Attorneys for the plaintiffs will have two weeks to adjust their complaint against the NCAA and co-defendants Collegiate Licensing Company and Electronic Arts.

Contrarily, the defendants will not be allowed to amend their arguments until a future summary judgment. Wilken hinted during the June 20 hearing that she was leaning toward allowing plaintiffs to add a current athlete to their group. The most recent ruling ? it?ll be huge news when the athlete is identified ? also suggests Wilken could be leaning toward certifying at least part of the case.

Plaintiffs in the case are seeking damages for the defendants? use of college athletes? names, images and likenesses.

Say you and your buddy are boosters who want to pay a player, which of course is illegal per NCAA rules. You make a product that includes that player's likeness. Maybe you make a jersey with that player's number on it. I'm guessing that in order to sell that jersey, you need to pay for rights to the university and to the NCAA. But you've become extremely wealthy doing whatever, and can afford to pay them. Your buddy says to you, "Hey - I REALLY like that jersey. I'll give you $100,000 for that jersey." So you sell him the jersey for $100,000. It cost you $10 to make it, plus, let's say, $9,990 to the NCAA and the university and to anyone else you need to in order for this to be legal. Now, you can say, "Since it's this dude's likeness, I need to pay him, too." You could give him the $90,000 profit.

I'm not sure which side of this issue I'm on. It will be interesting to see what Title IX has to say about this..

Judge allows O'Bannon case against NCAA to go to trial

Ed O'Bannon's four-and-a-half year legal battle with the NCAA took a major turn Thursday, with a federal judge ruling that the class-action antitrust lawsuit may proceed to trial.
The NCAA had asked US District Judge Claudia Wilken to dismiss the suit, but she noted Thursday that "the whole case is not going away on summary judgment."
Barring a settlement, the trial is scheduled to begin June 9.

NCAA motion denied by judge in O’Bannon case

The NCAA took another blow in their fight in the Ed O’Bannon lawsuit Monday. A U.S. district judge denied a motion filed by the NCAA requesting a reconsideration of an original ruling.

According to the Associated Press, the NCAA requested U.S. Judge Cynthia Wilken reconsider her original ruling from April 11 against a summary judgement.

Per the Associated Press [via USA Today];

At issue was Wilken’s decision that, at trial, the NCAA will not be able to say that one of the justifications for limiting what athletes can receive for playing college sports is that the limits enable schools to provide increased financial support for women’s sports and less prominent men’s sports.

The prohibition on that argument will remain the case as the case heads toward a scheduled trial date of June 9.

The NCAA may have swung and missed on this particular motion, but the AP reports the NCAA has three more pending motions to file before the trial gets underway next month.

Emmert takes stand in O'Bannon trial

NCAA president Mark Emmert defended the organization's role in college sports as he took the witness stand Thursday.

NCAA president Mark Emmert stuck to his contention that amateurism is the core of college athletics, saying any effort to pay players would destroy a framework that has been in place for more than a century and cause many schools to either abandon sports or refuse to play other schools that do pay.

Emmert said college athletes themselves wouldn't want to play against other athletes who were getting paid.

"They want to know everyone is playing by the same rules," he said. "They want to know the other teams consist of student-athletes just like them."
