That's why they have trials. If, during the trial it is proven that race (or sexual preference, or gender, etc.) was one of the prime, if not the sole, motive of the commission of the crime (such as the bombing of the Alabama church in 1964 which killed four black girls, the murdering of that homosexual kid up in Montana in the 1990s, etc.). The simple utterence of a slur doesn't constitute racism.

The jury never gets a chance to consider the issue at trial unless the DA charges him with the hate crime. Besides, we don't know that what is reported is all that the DA knows. For all we know, they could've found something in his truck or residence that supports a hate crime prosecution.

The simple utterence of a slur doesn't constitute racism. For example, I had a big-ass local guy cut his pickup in front of me at a shopping mall because he said I had cut him off earlier. He got out and came toward my car calling me a "Fucking Haole". When I got out, I initially refrained from using any slurs, but as he kept calling me that, I retaliated by calling him a "Stupid fucking local" and a "Fucking Moke". Now, does that make me a racist? I don't think so, but by your definition it does. By the way, he end up being all bark and no bite as he never made his move and I eventually got tired or yelling with the moron and left.

You are right that is what they have trials for, and the way a trial works is you are charged with something and then it has to be proven....not you are taken to court and see what charges show up.

So what will happen is he will be charged with a hate crime, and then the lawyer will have to prove that indeed it was a hate crime. After the evidence is presented then a group of people ( they are called a jury) will go into a room and review the evidence that they were presented and then the will come back and give the verdict ( all the people on the jury have to agree). At that point it will move to the sentence phase, in which the judge will decide how long the criminal will be in jail.

As far as your little story about the parking lot, no that once incident would not show you are a racist. It would show that you have some sort of hatred and dislike towards that group of minority. (unless of course you gre up in their neighborhood:roll1: ). More so the story shows you must have real anger issues, I mean really if the guy started yelling and cussing at you because he thought you cut him off what was the point of getting out of the car? Why not just stay in your car and drive off, rolling you eyes at him? Although I am sure it al least entertained other people in the parking lot as they thought why are those two idiots over there yelling at each other.

So, if someone bombards me with racist remarks, my retaliation-in-kind shows that I "have some sort of hatred and dislike towards that group of minority", which by the way would fit the definition of "racist", despite that in your previous sentence you said those actions "would not show you are a racist". So, which is it? You seem to have a double standard, like several folks on this board.

As for why I didn't just drive away, read my post again. He had cut me off (blocked my passage). This was is a thoroughfare in a shopping center and there were cars behind me. I'm not about to sit in my car, essentially boxed in, while some big-assed Hawaiian guys comes over and pounds me through the driver window...if there's any poundings to be handed out, I'm going to make sure that most of it is going to be administered by me.

Back to the original point of the thread. There's a little more to this than what is being reported. If this scrawny little trailer-trash (oops, that's racist...I can't say that :roll1:) punk simply ripped off a few "N-words" while he confronted Taylor, then that in itself doesn't constitute it being a "hate crime". But if it should be found that his motive for attacking Taylor was based on Taylor being non-white, then that qualifies under that hate statute and he should be hit with it.

I think you're heading in the right direction with this statement. I guess we need to know more information before we pass judgement on whether it was a hate crime or not.

Hate crimes are always touchy cases and aren't as cut and dry as they may seem.

I happen to agree that just b/c he used the n-word doesn't mean a hate crime occurred in my opinion.
