Disturbing Story (Non-tOSU)

my opinion is the insurance company should pick up the policy. obviously there is ntohing forcing them to. but i think it was clear that it was something all parties were interested in at the time including the insurance company. the only thing that kept it from happening was poor time management on both the school, the student, and the family. while those errors have nothing to do with the insurance company, as much business as UGA likely provides and the likely few times they actually make claims. i think as the insurance company you eat this one. its only 500k and just think of the positive publicity. better than a 30 sec shot in the superbowl and a whole lot cheaper.

"It's only $500,000." You must be pretty flippin' rich to have an opinion like that on $500,000. And I don't know why you think that would help out their publicity. If it would help their publicity, don't you think there'd be insurance companies lined up to the corner drug store and back waiting to give this guy money, just for their publicity?

The only way I can see that the guy has a case (and I'm not an attorney in any way, but this one time my left middle finger sued my right ear lobe, so I'm about 90% an expert) is if he spoke with the insurance company either on the phone or in person, and they agreed that he would sign a policy, AND that they agreed upon a specific policy. That would constitute an verbal contract, which I understand is just as unbreakable as a written contract. The verbal contract, of course, is more difficult to prove was ever made. But this is only if they said, "I'll give you X dollars and then you give me Y dollars if I get hurt on the football field." If no X's or Y's were agreed-upon, the insurance company could say, "Ok, we agreed on a policy for you, and so here's a policy. Sign here and pay us the X dollar premium, and then, since you're already hurt and we don't see a reason to insure you for $500,000, we're going to insure you for $1.

I would still like to hear the insurance company's side of the story.
