Ok...it has to be hard to lose a child...but are you fucking kidding me?!?

The thing is most states have the same laws that allow these kind of lawsuits.

In Ohio if some walks in has a drink and then goes and causes any accident, the resturant, manager on duty and even the server/bartender can all be sued.

from what i have read so far, there is 3 suits being filed from his father now. he is suing the owner of the stalled car, the owner/manager/bartender of the bar, and the tow truck driver. i really wouldn't be surprised in the least if he won at the very least one of the suits. if he won all 3, i would be surprised but not completely taken back by it. this is one thing i hate about the legal system in its gray area. i used to work at a greenhouse and we had statue displays off to the side of the wall with about 10 feet of walking room side to side. one day this rich spoiled woman came in and started erupting like mt st helens about how she was going to sue the owners because the statues were in her way and she fell over them. it is the hardest thing to deal with these people, because they are so out of touch with reality that they honestly believe that it was our fault for them being stupid enough to walk and trip over a statue of a goose when there is 10 feet of walkway for you to use. you have to be as courteous as you possibly can to calm them down, yet all i really wanted to do is take the goose statue and smash it into her head for being such an idiot. she won her lawsuit too. frankly, maybe these people are just playing the system and deliberately trying to exploit the system for any amount they want. i will keep that in my mind the next time i need money for tuition. i will just go to home depot and knock a shovel off a rack deliberately and say it was their fault for not putting the shovel on the rack all the way.

I thought just that when I saw your post in the Pata thread.

This reminds me of Willie Shoemaker suing multiple entities, including the state for not having a good enough guardrail, when he was drunk and flipped his car.

I know that, and at least I understand the thought process there even though I don't agree with it. I can't believe he's suing the tow truck company and driver and the owner of the stalled car...what a tool. I'd countersue for causing undue emotionally distress or something for crashing into me while drunk.

we could create a butterfly effect of lawsuits if we wanted. retards sues the owner of the car, owner sues mechanic, mechanic sues part company, part company sues R&D crew, R&D crew sues ohio state math program for not instructing them correctly, osu math program sues instructor, instructor brings a countersuit against osu, etc, etc.

idiotic right?..........well if he is able to do these kinds of lawsuits, i don't see how it would be out of the realm of possibility that they could all do the same.

Cowherd said today that in the UK, if they determine you filed a frivalous lawsuit you have to pay all court fees for both sides.

I'm sure there are ways that could be problematic (which lawyer types would understand better), but on the surface that seems like a great alternative to the mess we have now.

Well, that would just make too much sense, and as such could not possibly be implemented in our judicial system.


You know, I've been trying to think just what kind of "guilt" you can assign to the driver of the stalled car and the operator of the tow truck, and I can't come up with any...

frankly it is more absurd than prosecuting the mentally handicapped. nobody can predict the future, and given the situation in which the driver was impaired at the time, it should be put on him, since he was the liability in the situation. even if their was a fiery crash ahead of him, maybe he would have stopped, or gone around carefully, instead of being on a cell phone, drunk, and potentially high at the same time.

When I was on active duty, I had several folks who had been assigned in Turkey tell me that if you're stopped at a stop light and another car hits you it's your fault because had you not been there you would've been hit. These same folks also said that they weren't allowed to take taxis in Turkey because if they got into an accident while ferrying you, you were at fault because had you not hired the taxi he wouldn't have got into that accident. Could be BS, but that sounds about as absurd as the Hancock case...

see this is where i hate how legal systems and other scenarios where they are completely systematic in these situations. its a total system of kantian ethics instead of using the logic and reasoning of modern philosophy that most of the rest of the world lives in. in that sense it is completely absurd and following a principle by which logic and reasoning has already proven wrong.......yet they still want to follow it. :crazy:

Hancock family drops lawsuit





ST. LOUIS ? The family of late Cardinals pitcher Josh Hancock dropped a wrongful-death lawsuit against Mike Shannon's restaurant stemming from the player's death in April.
The family's lawyer, Mark Bronson, said he filed a motion to dismiss the lawsuit before a procedural hearing Monday in St. Louis Circuit Court. The lawsuit had alleged that others shared responsibility for Hancock's death.
He referred questions to Hancock lawyer Keith Kantack in Tupelo. Kantack did not immediately return a phone call seeking comment.
Hancock, a 29-year-old relief pitcher, died after a St. Louis Cardinals home game in April when he crashed his sport utility vehicle into the back of a tow truck stopped on U.S. 40 in St. Louis. The lawsuit was filed a month later by Hancock's father, Dean Hancock.
The lawsuit alleged that others shared responsibility for Josh Hancock's death, including Mike Shannon's restaurant. Judy Shannon, wife of the Cardinals' broadcaster and former player, died Saturday after a battle with brain cancer.
