Cops and Teachers (split from Henton)

Best Buckeye

Pretending I'm a pleasant person is exhausting.

Agree 100% being familar with legal shit through the years. if he was set up or maybe this word is better "entrapment" he has a case. So Henton should use all his angles, .

So just how many times have you been arrested for soliciting.

Quite the contrary. It means everything. Understand we're talking about two things here. 1 - it seems you're talking about the pending criminal charges. In this respect, I have no problem with the notion that Henton is not guilty of the crime. That's why we don't have cops play the role of judge and jury. An arrest does not become unlawful simply because you cannot convict. 2 - what I'm talking about - a civil case filed by Henton against the cops for wrongful arrest. I don't know how to say it any more clearly than I have, but the elements of Solicitation were present, and thus any "wrongful arrest" civil suit should fail as against the cops. Furthermore, I don't assume all arrests are valid.... I just have some expirience dealing with the law that surrounds civil suits based on the theory of wrongful arrest. It is the rare case where a Plaintiff will succeed against the police. Especially where the essential elements of a crime - here, offer and acceptance of prostitution for a price certain - are present. Simply put, the cops enjoy immunity for charging Henton.

You obviously have never seen first-hand cops flaunt their authority and threaten arrest towards people who were doing nothing. Case in point: Two summers ago I was cycling with our training group on a Sunday morning. One of the better riders in the group had stopped for a stop sign without putting his feet down (some of the triathletes or better cyclers here will you that an experience road cyclist can stop completely and remain balanced for several minutes if not indefinitely). A patrol cop who was at the corner chased him down and stopped him and was going to give him a ticket for running a stop sign, despite the fact he saw him stop completely, solely because the cyclist didn't put either foot down and thus "couldn't have stopped". When the cyclist offered to show the cop that he can indeed remain stopped on his bike without putting his feet down, the cop said "All you cyclists are the same...always running stop signs and getting in cars' way". The cop clearly had a personal thing against bikes on the road. The only thing that kept the cycler from getting a ticket was one of the girls in the next pack of rides saw him getting chastised by the cop and she knew the cop...she was pretty good looking so she was able to charm the cop into letting him off. Bottom line was the cycler was going to get a ticket, which in Hawaii a road violation on a bicycle counts the same as if the violation occurred while driving a car, simply because the cop had a thing for cyclers for whatever reason.

Hmmmm.... I don't know how my analysis of the hypo espoused on this thread as it relates to the applicable law means I have obviously never seen cops abuse their authority, but whatever.

Because just as the cop had a hard on for cyclists based on limited experiences...Mili has a hard on for cops based on one experience. It's what us on the mainland call hypocrites....

Dirty cops are everywhere and get an ego trip out of their power-mongering ways.
