MIAMI-DADE COUNTY, Fla. -- A man who allegedly was fleeing police was attacked and killed by an alligator in a pond, Local 10 reported.

Miccosukee police, assisted by Sweetwater canine units, responded to a call on the Miccosukee Indian Reservation about vehicles being broken into.

Local 10's Todd Tongen said police captured one man, but another fled on foot and dove into a retention pond. Signs warned of the danger of live alligators in the pond behind the casino and hotel.


If an alligator either digests or kills a person it's a state law through Florida Fish and Wildlife that it be destroyed, so the alligator will be put in an incinerator or be buried, Tongen reported.
 
Re: "Local 10 learned the larger alligator was well known on the reservation and employees had nicknamed it Poncho."

At the end of the Cisco Kid TV show after Poncho would say "ahhh Cisco" then the Cisco Kid would say: "ahhh Poncho".

They shouldn't kill the alligator (Poncho), they should deputize him. :biggrin:

Does Florida Fish and Wildlife have the same authority on an Indian reservation? Too bad if they do, they should give the gator a treat instead.

I represent this alleged "alligator" - let's say that he is a big reptilian for the sake of argument. We strenuously maintain that the alleged victim was not "digested", so at bare minimum the law as applied to my client - who is only accused of eating him - is vague and unclear. If my client shits him out later, and DNA tests confirm the identity, we can revisit the issue. I ask for personal recognizance.( Five thousand dollars now buddy, and don't swish your tail like that at me)

The statute clearly says digests OR kills. As co-counsel for Mr. Gator, I would hasten to add to my esteemed collegue from Lousiana's statement that there is no proof that my client's action was the proximate cause of the thief's death. He could've died as a result of having dived into the shallow end of the pond. He could've drowned through no fault of my client. In fact, upon information and belief, my client was simply trying to save the thief and turn him over to the proper authorities when he gingerly and respectfully embraced the thief with his mouth. Of course he used his mouth, alligators don't have hands. Should my client be victimized for handlessness? That is nothing less than repetilian discrimination on the basis of immaterial anatomical differences.
