MKV and MP4 are just the container, it is the same video file regardless. Not sure why apple is so stupid about things like that.........

Ya its the re encoding that fixes it not the container. I think apple is picky about the AVC video codec which is what your capture program uses.
It's not consistent because your OSU at Navy torrent plays fine. I just used handbrake at 2500 bitrate plays fine on ipad now.
