John W. Smiley, 32, of Fort Mitchell, Ky., could spend up to five years in prison on his convictions Monday for gross sexual imposition and attempted gross sexual imposition. He will be sentenced April 19 in Franklin County Common Pleas Court.Smiley had previously pleaded guilty to a gross sexual imposition count in Montgomery County.At Ohio State, two male patients complained that they found Smiley holding their genitals as they came out of anesthesia in November 2004, said Sue Ann Reulbach, assistant Franklin County prosecutor."The victims were unable to resist, in fact, because he had overmedicated them," Reulbach told Judge Charles A. Schneider.The Montgomery County conviction stems from an accusation that Smiley groped a male patient at Good Samaritan Hospital in Dayton in February 2004. He was sentenced to five years' probation.Ohio State officials were not aware Smiley was under investigation in Dayton when he was hired as a freelance nurse, a prosecutor said.Smiley's arrest prompted the university to require criminal background checks before hiring nurses, said hospital spokesman David Crawford.Smiley's Ohio nursing license was revoked last year. Reulbach said Smiley also had his nursing license revoked in Kentucky.In June, Smiley was arrested at a children's camp near Burlington, Ky., for failing to register as a convicted sex offender. Authorities said he had volunteered there for one day.He is a registered sex offender in Ohio and Kentucky.___
