[FONT=arial, helvetica]A Madeira man who is a student at Yale University claims in a lawsuit that US Airways stole a video game console from his luggage during a flight, and he wants $1 million in compensation.[/FONT]
[FONT=arial, helvetica]Jesse Maiman, 21, filed the suit Monday in Hamilton County Common Pleas Court.[/FONT]
[FONT=arial, helvetica]In it, he noted that he took a Dec. 17, 2008, flight from New Haven, Conn., to Cincinnati/Northern Kentucky International Airport. Included in his luggage for that trip was his Xbox 360, which had a specialized hard drive and components he said cost more than $1,000.[/FONT]
[FONT=arial, helvetica]When he picked up his luggage after landing, though, he noticed how light it was. He opened the bag, the suit noted, and he saw that everything was there except the video-game console and its accompanying components.[/FONT]
[FONT=arial, helvetica]He immediately went to a US Airways representative at the airport to report what he called a theft.[/FONT]
[FONT=arial, helvetica]What followed, his suit alleges, was weeks of "an unconscionable 'run-around' " that saw him write or speak to five airline employees who gave him what he considered to be nonresponsive answers.[/FONT]
[FONT=arial, helvetica]"This was an annoyance that they really hoped not to deal with," Maiman said.[/FONT]
[FONT=arial, helvetica]"That thing was my DVD player," Maiman, a junior film studies major, said. He was the 2006 Madeira High co-valedictorian.[/FONT]
[FONT=arial, helvetica]The suit seeks to have the airline pay him $1,700 for the loss of the gaming system and for "non-economic distress" of at least $25,000, but "in the maximum amount allowable by law or, in the alternative, in the sum of $1,000,000."[/FONT]
[FONT=arial, helvetica]A US Airways spokeswoman said the airline was unaware of the lawsuit.[/FONT]
[FONT=arial, helvetica]"We haven't been apprised of any lawsuit yet, but regardless of the figure in the complaint, there are federal loss limits applicable to all airlines on their liability for lost luggage and belongings, which are currently set at $3,300 per bag," Valerie Wunder, a US Airways spokesperson, said in an e-mail. "Further, our publicly available baggage policies specifically exclude liability for electronics checked in luggage."[/FONT]

"That thing was my DVD player!!!" Cry me a river, douchebag! I hope the judge orders his mommy and daddy to give him $30 to get a new DVD player from KMart, and throws the rest of this crap out.

By the way, if you are going to spend $1000 modding an Xbox that you are probably using to circumvent copyright protection, you may not want to mention that in court.

I agree, but I also disagree. It is what people are suing for. It's over the pettiest things ever. I am actually about to file a lawsuit against someone, well a company, for what they did to me, but what happened to me was ridiculous. So as I do agree with you, people are lawsuit happy, but there are circumstances that they are needed.

Look, it the employee break room does not have enough Sweet and Lo in the dispensers on Thursdays, then they don't put enough Sweet and Lo out there - and I'd really appreciate it if you could offer some support for the guy instead of this needless criticism.

Don't have any idea what a X-box costs, or is or does, sounds like something from an Adult Book store, but if it's value exceeds 1G it becomes grand theft, n'cest pas?

1st bold: The key word is "lost". The Xbox was "taken" from secured luggage, i.e., it was stolen while under the airline's control.

2nd bold: Their policy may exempt them from damage to electronics, but it shouldn't exempt them from outright pilferage.

That being said, the kid should be reimbursed fully for the cost of a new Xbox plus legal fees and possibly some small punitive award...airlines need to pay for their incompetancy. Above that, tough shit...

No sympathy here.

If I can get two laptops and a projector in one laptop bag for under-seat luggage, plus four days worth of suits and sundries in a 19" wheeled carry-on, then this Ivy Leaguer should have been able to figure out (1) a way to get an Xbox on an airplane without having to check it or (2) to put it in a padded Pelican-style locking case made for carrying sensitive electronics.

Well something happened at work which knocked out my front tooth which happened on a Friday. Went to work on Monday and they fired me. They then tried to cover it up saying I was dicking around at work, which is total bullshit. That's why my size 12 is going up their ass.
