Broncos running back Travis Henry is in danger of being suspended by the NFL for a year if he’s unsuccessful in blocking a positive marijuana test in federal court, according to published reports out of New York.
Newsday reported that Henry filed a lawsuit Sept. 20 in Suffolk County Supreme Court seeking a restraining order that prevented the league from using a urine specimen against him and making the test results public.
That request was granted, but the NFL then got an appellate court to vacate the order, the paper said.
The league went to federal court in Brooklyn on Monday in an attempt to have the lawsuit transferred to their jurisdiction because that branch generally handles labor laws. It’s the NFL’s contention that collective bargaining issues are in dispute, Newsday reported.
Henry reportedly is claiming the NFL violated its own substance-abuse policy by not allowing his experts to be on hand when the urine sample was tested.
