There will surely be plaintiff's who don't live in Xichigan, which would move the case to the Federal level.
I think that's the point of the 11th Amendment defense, to say the the state of Michigan can't be sued in federal court by citizens of another state. And of course, lots of other plaintiffs surely are citizens of Michigan, which is why it seems like if the defense works, it just makes you fight in both federal and state court, unless maybe they move it all to state court, which I think is what BKB is suggesting. I'm a lawyer, but not a litigator, and haven't looked at any of the filings, so I'm just guessing based on my general constitutional law knowledge.

Fwiw, I havent had to worry about those issues from a litigation perspective in some time. I just assume the state of Michigan, like Ohio, defined the conditions under which it could be sued.
Have you ever tried to argue that your side is in the right, with the stated reason being: "because"?

GTFOH with these arguments. They really have a screw loose.
They need to protect that conference leading endowment fund and with the potential for this case to go nuclear it’s in their best interest to look for any potential way out.

MSU and PSU thought it was in their best interest to bend over and take it. However, here we are with this clown university who doesn't want to take responsibility for any problem, even when there are young females who have been sexually victimized at the hand of their employee (possibly "s").
